Terms of Use

Welcome to fluxai.art (the "Site" or the "Service"). By accessing, browsing, or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use ("Terms") and our Privacy Policy. These Terms constitute a legal agreement between you and MIRA MUSE LLC ("MIRA MUSE", "we", "us", or "our"). If you do not agree with any part of these Terms, you must immediately discontinue your use of the Site.

fluxai.art is a consumer web application for AI-assisted image generation and editing. Users submit text prompts and/or upload images, and the Service returns images generated or modified by artificial-intelligence models ("Outputs"). The Service is provided for personal and lawful creative use.

You must be at least 18 years old to use the Service. By creating an account or using the Service, you represent and confirm that you are 18 years of age or older and have the legal capacity to enter into these Terms. We do not knowingly collect personal information from, or provide the Service to, anyone under 18. If we learn that an account belongs to a person under 18, we will terminate the account and delete associated data.

To access certain features you may be required to create an account. You agree to provide accurate, current, and complete information and to keep it updated. You are solely responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to notify us immediately at support@fluxai.art of any unauthorized use of your account. Accounts are personal to you and may not be shared, sold, or transferred. We may require identity or human verification (for example, a CAPTCHA challenge) to create or continue using an account.

5.1 Plans. We offer paid subscription plans that provide monthly credits and premium features. Plan details, prices, and included credits are shown on the Pricing page at the time of purchase.

5.2 Billing and renewal. Subscriptions are billed in advance on a recurring basis (monthly or annually, as selected) and renew automatically at the end of each billing period at the then-current price until cancelled. You authorize us and our payment processor to charge your payment method for each renewal.

5.3 Cancellation. You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you keep access until then. No partial-period refunds are issued for cancellation.

5.4 Refund policy. New customers may request a full refund of their first purchase within 3 days of the purchase date by contacting support@fluxai.art. Refund requests submitted after the 3-day period, and requests relating to renewals or subsequent purchases, will not be accepted, except where required by applicable law.

5.5 Credits. Credits are consumed when you generate or edit images. Unused credits expire at the end of the billing period in which they were issued unless stated otherwise on the Pricing page. Credits have no cash value and are non-transferable.

5.6 Price changes. We may change plan prices with at least 30 days' notice. Changes apply from your next billing period.

5.7 Taxes. Prices may exclude applicable taxes, which will be added where required.

6.1 User Content. When you submit prompts, upload images, or otherwise provide material to the Service ("User Content"), you represent and warrant that you own all rights in the User Content or have all rights necessary to use it with the Service, and that its use does not violate these Terms or any law.

6.2 License to us. You retain ownership of your User Content. You grant MIRA MUSE a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and display your User Content and Outputs solely for the purpose of operating, providing, securing, and improving the Service and enforcing these Terms.

6.3 No training on your content. We do not use your prompts, uploaded images, or Outputs to train or fine-tune AI models.

6.4 Outputs. Subject to your compliance with these Terms, you may use Outputs for lawful purposes. You acknowledge that Outputs are generated by AI, may be similar to Outputs generated for other users, may contain errors or artifacts, and are provided without any warranty of accuracy, originality, or non-infringement. You are solely responsible for how you use Outputs.

You may not use the Service to create, upload, request, generate, store, or distribute content that:

(a) depicts, sexualizes, or exploits minors in any form, including child sexual abuse material (CSAM), whether real, drawn, or AI-generated; (b) depicts non-consensual sexual activity, or sexually explicit or intimate imagery of any real, identifiable person without that person's explicit consent; (c) depicts a real, identifiable person in a false, misleading, defamatory, or harmful manner without that person's consent, including "deepfake" imagery; (d) depicts or promotes terrorism, violent extremism, genocide, or violence or hatred against individuals or groups based on protected characteristics; (e) depicts gratuitous gore, mutilation, bestiality, or animal cruelty; (f) facilitates fraud, phishing, scams, impersonation, or the creation of forged or counterfeit documents, identification, currency, or credentials; (g) infringes the copyright, trademark, publicity, privacy, or other rights of any third party; (h) promotes illegal drugs, illegal weapons, or other unlawful goods or activities; or (i) is otherwise unlawful in the United States or in the jurisdiction where you are located.

You further agree not to: attempt to circumvent our content filters or safety systems; use automated means (bots, scrapers) to access the Service except through interfaces we expressly provide; reverse-engineer the Service; resell or redistribute the Service; or interfere with the security or operation of the Service or other users' accounts.

8.1 Automated screening. Every prompt and every generated Output is screened by automated safety systems before it is delivered to you. Requests that violate Section 7 are rejected and logged.

8.2 Human review. Our operations team reviews flagged content, user reports, and unusual account activity, and may remove content, refuse requests, or take action against accounts.

8.3 Abuse prevention. To prevent abuse and evasion we use human-verification challenges, device and network identifiers, and account-level usage limits. Persons whose accounts have been terminated for violating Section 7 may not create new accounts.

8.4 Reporting. Anyone may report suspected illegal or prohibited content by emailing support@fluxai.art with the relevant URL or account information. We review reports promptly and take appropriate action.

8.5 Cooperation with authorities. We may preserve and disclose content and account information, and report suspected child sexual abuse material or other unlawful activity, to law enforcement and to organizations such as the National Center for Missing & Exploited Children (NCMEC), as required or permitted by law.

If you believe that content available on the Service infringes your copyright, send a written notice to support@fluxai.art (subject line "Copyright Notice") that includes:

1. identification of the copyrighted work you claim has been infringed;
2. the URL or other information sufficient to locate the allegedly infringing material on the Service;
3. your name, mailing address, telephone number, and email address;
4. a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;
5. a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf; and
6. your physical or electronic signature.

We will remove or disable access to material in response to valid notices and will terminate the accounts of repeat infringers. If you believe material was removed by mistake, you may send a counter-notice to the same address containing the information required by 17 U.S.C. § 512(g).

The Site and its contents, features, and functionality (excluding User Content and Outputs) are owned by MIRA MUSE LLC, its licensors, or other providers and are protected by United States and international intellectual property laws. Our trademarks, service marks, and logos may not be used without our prior written permission.

We may suspend or terminate your account and access to the Service, with or without notice, if you violate these Terms (including Section 7), if required by law, or if we reasonably believe your use poses a risk to us, other users, or third parties. Amounts already paid are non-refundable where termination results from your violation of these Terms. You may terminate your account at any time by cancelling your subscription and contacting support@fluxai.art. Sections 6, 7, 9, 10, 11, 12, 13, and 16 survive termination.

THE SERVICE AND OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED AVAILABILITY. AI-GENERATED OUTPUTS MAY BE INACCURATE, INCOMPLETE, OR UNSUITABLE FOR YOUR PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIRA MUSE LLC AND ITS MEMBERS, OFFICERS, CONTRACTORS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS. OUR TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless MIRA MUSE LLC and its members, officers, and contractors from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your User Content, your use of Outputs, or your violation of these Terms or of any law or third-party right.

We welcome feedback and suggestions. By submitting feedback, you agree that we may use, disclose, and adopt it without restriction or compensation to you.

These Terms and your use of the Service are governed by the laws of the State of Colorado, United States of America, excluding its conflict-of-law principles. Any dispute arising from or relating to these Terms or the Service shall be resolved in the state and federal courts located in Colorado, and you consent to the jurisdiction and venue of such courts. Nothing in this section deprives you of mandatory consumer protections under the law of your country of residence.

We may modify these Terms at any time. If a change is material, we will provide at least 30 days' notice by posting the updated Terms on the Site and/or by email. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
